MEMBERSHIP TERMS AND CONDITIONS

ACCEPTANCE OF TERMS
By becoming a member of The Body Box, attending classes, using the gym facilities, using the sauna, participating in personal training sessions, or accessing the premises, you agree to be bound by these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions, you must not use The Body Box facilities or services.
HEALTH AND SAFETY
(a) Exercise, physical activity, sauna use, personal training, and participation in classes involve inherent risks including injury, illness, serious injury, and in rare circumstances, death.
(b) Members participate entirely at their own risk.
(c) Members are responsible for ensuring they are medically fit and physically capable of participating in any activity undertaken at The Body Box.
(d) Members must inform The Body Box of any medical condition, injury, illness, disability, pregnancy, or other circumstance that may affect their ability to exercise safely.
(e) Members must immediately stop exercising and seek medical advice if they experience pain, dizziness, faintness, chest pain, breathing difficulties, or any other concerning symptoms.
(f) The Body Box staff, coaches, instructors and personal trainers are not medical professionals and cannot diagnose, treat or provide medical advice.
UNMANNED FACILITY OPERATION
(a) The Body Box may operate with or without staff present at any time.
(b) Members acknowledge that they may enter the facility while it is staffed and remain on the premises after staff have left.
(c) Members acknowledge that they may enter the facility during periods where no staff are present.
(d) Members understand that supervision, instruction, assistance, first aid support, or emergency assistance may not be available during unmanned periods.
(e) Members use the facility entirely at their own risk whether the facility is staffed or unstaffed.
(f) Members are solely responsible for their own health, safety, conduct, and use of equipment whilst on the premises.
(g) Members acknowledge that The Body Box shall not be responsible for monitoring individual exercise sessions or ensuring equipment is used correctly.
(h) Members must exercise reasonable care when using all equipment and facilities.
GYM EQUIPMENT, CLASSES AND SAUNA
(a) Members must follow all instructions given by staff, coaches and instructors.
(b) Members must use equipment only for its intended purpose.
(c) Members must return equipment after use.
(d) Members must respect other members and staff at all times.
(e) The Body Box reserves the right to refuse participation in any class where it believes participation may present a safety risk.
(f) Sauna use is entirely at the member's own risk.
(g) Members should not use the sauna if they suffer from any medical condition that may make sauna use unsafe.
(h) Members should seek medical advice before using the sauna if unsure of their suitability.
PERSONAL TRAINING
(a) Personal training sessions must be paid for in advance unless otherwise agreed.
(b) Personal training cancellations require a minimum of 7 days notice.
(c) Sessions cancelled with less than 7 days notice may be forfeited.
(d) Refunds for unused sessions are granted solely at the discretion of The Body Box.
MEMBERSHIP FEES AND PAYMENTS
(a) Membership fees must be paid in accordance with the membership agreement.
(b) Membership fees are non-refundable except where required by law.
(c) Failed payments may result in suspension of membership access.
(d) The Body Box reserves the right to amend membership pricing with reasonable notice.
ACCESS CONTROL, ENTRY SYSTEMS AND SECURITY
(a) The Body Box may operate access control systems including but not limited to key fobs, membership cards, mobile credentials, QR codes, access codes, biometric identification, facial recognition systems and other electronic access methods.
(b) Members are responsible for safeguarding their access credentials.
(c) Members must not share, lend, transfer, duplicate or otherwise permit another person to use their access credentials.
(d) Members must not permit non-members to enter the facility using their membership.
(e) Any misuse of access privileges may result in immediate suspension or termination of membership without refund.
(f) Access records may be stored and reviewed for security, operational and membership management purposes.
CCTV
(a) CCTV operates throughout the facility and surrounding areas.
(b) CCTV footage may be monitored, recorded, stored and reviewed for:
Security
Crime prevention
Incident investigation
Health and safety purposes
Access control monitoring
Protection of members, staff and property
(c) By entering the premises, members consent to CCTV recording for these purposes.
JUNIOR MEMBERSHIPS (AGES 14-16)
(a) Junior Memberships are available only to individuals aged 14 to 16 years old.
(b) A parent or legal guardian must hold an active membership with The Body Box.
(c) A parent or legal guardian must accept these Terms and Conditions on behalf of the junior member.
(d) Junior members are responsible for exercising safely and using equipment correctly.
(e) Junior members may use the gym during permitted hours only.
(f) Sauna use is permitted only under direct adult supervision.
(g) Access to classes may be granted, restricted or withdrawn at the discretion of The Body Box.
(h) The Body Box does not provide supervision for junior members.
(i) If a parent or guardian permits a junior member to train without direct supervision, the parent or guardian accepts full responsibility for the junior member's health, safety, welfare and conduct.
(j) By permitting a junior member to train alone, the parent or guardian confirms that they are satisfied the junior member is capable of training safely and independently.
(k) The Body Box shall not be responsible for supervising junior members or monitoring their exercise, equipment use, decisions or conduct.
(l) The parent or guardian accepts full responsibility for any risks associated with the junior member's participation in gym activities, classes, sauna use and facility access, whether the facility is staffed or unstaffed.
(m) The Body Box reserves the right to suspend or terminate a Junior Membership where it believes continued participation presents a safety risk.
LIABILITY
(a) Nothing within these Terms and Conditions excludes liability where liability cannot legally be excluded under applicable law.
(b) To the fullest extent permitted by law, The Body Box shall not be liable for injury, illness, loss, damage, theft, death or any other claim arising from a member's use of the facilities, classes, sauna, personal training services or access to the premises.
(c) Members acknowledge that they participate in all activities entirely at their own risk.
(d) Members agree to take responsibility for their own actions whilst using The Body Box facilities.
TERMINATION OF MEMBERSHIP
(a) The Body Box reserves the right to suspend or terminate membership for:
Breach of these Terms
Dangerous behaviour
Abuse towards staff or members
Misuse of access systems
Criminal activity
Non-payment
(b) No refund shall be due where membership is terminated for breach of these Terms.
PRIVACY
(a) The Body Box collects and processes personal information in accordance with its Privacy Policy.
(b) Personal information may be used for membership administration, access control, communication, safety, security and legal compliance.
CHANGES TO TERMS
(a) The Body Box reserves the right to amend these Terms and Conditions at any time.
(b) Updated Terms and Conditions shall take effect upon publication on the website, member portal, or other communication channels.
By becoming a member, accessing the premises, attending classes, using the sauna, participating in personal training, or using any facility operated by The Body Box, you confirm that you have read, understood and agreed to these Terms and Conditions.
